Lease Agreement: Automatic Transfer of Apartment Lease

On 1.11.2011, the amendment of Act No. 40/1964 Coll., the Civil Code, will become effective, bringing significant changes to the regulation pertaining to lease of residential apartments. The amendment affects, for example, the rights and obligations arising from apartment lease, the payment of security deposit, extinction of apartment lease, reasons for the lease termination, substitute accommodation, etc. This amendment also significantly modifies the provisions of Section 706 of the Civil Code pertaining to the automatic transfer of apartment lease. If the tenant of an apartment dies, the rights and obligations arising from apartment lease automatically pass to the person who lived in the apartment together with the tenant at the time of his/her death, provided that such person has no apartment of his/her own. However, if such person is someone else than the tenant´s spouse, partner, parent, sibling, son-in-law, daughter-in-law, child or grandchild, the rights and obligations arising from the apartment lease shall only pass to such person if the landlord has granted its written consent with the person´s accommodation in the apartment. The lease relationship established in this manner between the landlord and the new tenant must terminate no later than upon expiry of two (2) years after the apartment lease transfer. However, this does not apply if the new tenant is older than 70 or younger than 18 years at the moment of apartment lease automatic transfer. In case of a minor, the lease shall terminate no later than on the day of the new tenant´s 20th birthday, unless the landlord and the new tenant agree otherwise.
